These Creator Terms of Service ("Creator Terms") constitute a legally binding agreement between you ("Creator," "you," or "your") and Stat Sniper, Inc. ("Stat Sniper," "Company," "we," "us," or "our") governing your participation as a monetizing content provider on the Stat Sniper platform, including the Stat Sniper mobile application, website, APIs, social feed, messaging features, subscriptions, and pay-per-view content marketplace (collectively, the "Platform").
By creating a Creator account, enabling monetization features, or receiving compensation through the Platform, you agree to be bound by these Creator Terms, our general Terms of Service, Privacy Policy, and the Stripe Connected Account Agreement.
If you do not agree, you may not monetize content on Stat Sniper.
1. PLATFORM PURPOSE
Stat Sniper is a social media and analytics platform for sports discussion and opinion-based content.
Stat Sniper:
Does NOT accept wagers
Does NOT operate a sportsbook
Does NOT broker bets or facilitate betting transactions
Does NOT guarantee outcomes or results
Does NOT provide financial advice, investment advice, or professional gambling counsel
Does NOT endorse any specific sportsbook or betting platform
Creators publish opinions, commentary, entertainment, and personal analysis only.
All wagering activity occurs solely between users and third-party licensed sportsbooks operating independently of Stat Sniper.
You acknowledge and agree that:
Your content is entertainment and informational commentary only
You are not acting as a bookmaker, agent, betting intermediary, or financial advisor
You are not representing Stat Sniper in any capacity beyond content creation
Users assume all risk when acting on your content
2. CREATOR ACCOUNT ELIGIBILITY
To become a Creator you must:
Age & Legal Status
Be at least 21 years old (or age of legal majority in your jurisdiction, whichever is higher)
Have legal capacity to enter into binding contracts
Identity Verification
Complete Stripe Connect onboarding and identity verification
Provide government-issued photo ID
Verify contact information (email, phone)
Submit additional documentation upon request (proof of address, business documentation)
Financial Information
Create and maintain Stripe Connected Account in good standing
Provide accurate taxpayer identification (SSN/EIN for US, equivalent for international)
Complete IRS Form W-9 (US) or W-8BEN (international) via Stripe
Link valid bank account or debit card for payouts
Maintain current contact and banking details
Geographic & Professional Restrictions
Not be a resident of a jurisdiction prohibiting sports betting content monetization
Not be employed in restricted sportsbook roles (detailed in Section 2A)
Not be subject to gambling-related legal restrictions or bans
Not be located in embargoed countries or on OFAC restricted lists
Be in a country where Stripe Connect payouts are supported
Platform Compliance
Agree to comply with all Platform policies and guidelines
Maintain account in good standing
Not have previously been banned for violations
Pass Stripe's identity verification and fraud screening
We reserve the right to deny or revoke Creator status at any time, for any reason or no reason, with or without notice.
2A. PROHIBITED CREATOR CATEGORIES
The following individuals are INELIGIBLE to become Creators:
Sports Industry Insiders
Current professional athletes in sports covered by the Platform
Coaches, trainers, or team staff with access to non-public information
Sports officials, referees, or umpires
League employees with access to competitive information
Team owners or investors with decision-making authority
Sportsbook Personnel
Sportsbook employees in: odds compilation, risk management, trading, line setting
Individuals with access to proprietary betting data or models
Compliance or regulatory staff at sportsbooks
Exception: Marketing, customer service, or general operations roles may be approved with disclosure
Individuals with Relevant Criminal History
Anyone convicted of sports betting fraud, match-fixing, or related offenses
Anyone currently under investigation for gambling-related crimes
Anyone with documented history of bookmaking or illegal gambling operations
Other Restricted Parties
Individuals banned from casinos or sportsbooks for advantage play or fraud
Anyone subject to active restraining orders related to harassment or threats
Individuals who have previously violated these Creator Terms
Disclosure Requirement: If you fall into any gray area category, you must disclose this during application. Failure to disclose may result in immediate termination and forfeiture of earnings.
3. CREATOR MONETIZATION FEATURES
Creators may offer paid access to content through:
Monthly Subscriptions — recurring access to private feed content
Pay-Per-Post (PPV) — one-time purchase of individual picks or analysis
Bundled Packages — multi-post or time-limited access bundles
Private Feed Access — exclusive content stream for paying subscribers
Premium Messaging Tiers — DM access or priority response for subscribers
Platform Role
Stat Sniper acts solely as:
Payment facilitator via Stripe Connect
Marketplace host and technology provider
Content delivery infrastructure
Stat Sniper is not a party to the transaction between Creator and subscriber.
We do not:
Endorse Creator content or picks
Verify accuracy of predictions or analysis
Guarantee Creator performance or quality
Provide customer support for betting outcomes
4. REVENUE SHARE & PAYOUTS
Revenue Split
Creator receives: 82%
Stat Sniper platform fee: 18%
This 18% platform fee covers:
Platform infrastructure and technology
Content delivery and hosting
Customer support and dispute resolution
Fraud prevention systems
Platform development and maintenance
All Stripe payment processing fees (paid by Stat Sniper)
Creators receive 82% of gross revenue as a clean payout. You do not pay any Stripe processing fees—Stat Sniper covers these costs from our 18% platform fee.
Payment Processing via Stripe Connect
Stat Sniper uses Stripe Connect for all Creator payments. When you enable monetization:
You create a Stripe Connected Account linked to your Stat Sniper Creator profile
Subscriber payments flow through Stripe's infrastructure
Stat Sniper's 18% platform fee is automatically deducted
Stat Sniper pays all Stripe processing fees from our platform fee
You receive 82% of gross revenue via your chosen payout method
No Stripe fees are deducted from your earnings
You are bound by Stripe's Connected Account Agreement and Services Agreement.
Stripe Processing Fees (Paid by Stat Sniper)
For transparency, these are the Stripe fees that Stat Sniper covers on your behalf:
Domestic cards (US): 2.9% + $0.30 per successful charge
International cards: 3.9% + $0.30 per successful charge
Additional Stripe fees:
Currency conversion: 1% if applicable
Chargeback/dispute fee: $15.00 per dispute (regardless of outcome)
Failed payout return: $0.25 per occurrence
You do not pay these fees. Stat Sniper absorbs all Stripe processing costs.

Simple formula: You receive 82% of every transaction, clean and simple.
Stat Sniper absorbs all Stripe processing fees (typically 2.9-3.9% + $0.30 per transaction), chargebacks fees ($15 each), and other payment processing costs from our 18% platform fee.
Deductions from Creator Earnings
The following are deducted before payout:
Stat Sniper Platform Fee: 18% of gross transaction amount
Chargebacks: Full transaction amount (you refund the subscriber; Stat Sniper covers the $15 Stripe dispute fee)
Refunds: Full or partial refund amount as per Section 9
Negative Balance Recovery: Outstanding debts from prior chargebacks or refunds
Note: Stripe processing fees are NOT deducted from your earnings. Stat Sniper pays these from our platform fee.
Minimum Payout Threshold
Minimum balance for payout: $25 USD (Stripe standard minimum)
Balances below threshold automatically roll over to next payout cycle
No expiration on accumulated balances
Account closure: Balances >$10 paid out within 90 days; balances <$10 forfeited to cover administrative costs
Payout Schedule & Timing
Stripe Connect Rolling Payouts (Default):
Funds available 2 business days after successful charge (US bank accounts)
International accounts: 7 business days after successful charge
Automatic transfer to your bank account once balance meets threshold
Weekends and bank holidays may extend timing by 1-2 days
Manual Payout Requests:
Available once balance meets $25 threshold
Requested via Creator dashboard
Processed within same timeframes as automatic payouts
First Payout Delay (New Accounts):
7-14 day hold on first payout for Stripe identity verification
Required by Stripe's fraud prevention policies
Subsequent payouts follow standard 2-7 day schedule
Payout Methods (via Stripe)
United States:
ACH Direct Deposit (1-3 business days, no fee) — Preferred method
Debit card instant payout (up to $10,000/transaction, 1% fee, typically 30 minutes)
International (Stripe-supported countries):
Local bank transfer (timing and fees vary by country)
Available in 40+ countries including: CA, UK, EU, AU, JP, MX, BR, IN, SG, and more

You must:
Connect a valid bank account or debit card to your Stripe Connected Account
Ensure account information is current and accurate
Monitor Stripe dashboard for failed payout notifications
Update payout details immediately if banking information changes
Failed payouts due to incorrect information may delay payment by 30+ days and incur Stripe return fees ($0.25-$1.00 per failed attempt).
Negative Balance Policy
If your Stripe Connected Account balance becomes negative due to chargebacks, refunds, or disputed transactions:
Automatic Recovery:
Future earnings automatically applied to negative balance
No payouts issued until balance returns to positive
Negative balance displayed in Creator dashboard
90-Day Collection Window:
If balance remains negative for 90 days, we may:
Pursue collection through legal means
Report debt to credit agencies (if exceeds $500)
Suspend or terminate Creator account permanently
Pursue claims in small claims court or arbitration
Debit alternative payment methods on file
You authorize Stripe and Stat Sniper to:
Debit your bank account to recover negative balances
Withhold future payments until debt is satisfied
Share debt information with collection agencies
Reserve Policies
Stripe Risk-Based Reserves:
Stripe may automatically implement reserves based on risk assessment:
New accounts: Up to 20% of transaction volume held for 90 days
High chargeback rate (>1.0%): Up to 25-50% rolling reserve
High-risk vertical (gambling-adjacent): Standard 10-30% reserve
Suspicious activity flags: Up to 100% hold pending investigation
Reserve policies are determined by Stripe's automated risk algorithms and may change without notice.
Stat Sniper Additional Reserves:
We may impose additional reserves (separate from Stripe) for:
Chargeback rate >3%: Additional 15% rolling reserve for 180 days
Refund rate >10%: Additional 10% rolling reserve for 90 days
Pattern of subscriber complaints: Case-by-case reserve up to 30%
Sudden volume spike: >300% month-over-month increase may trigger 20% reserve
First major payout: First payout >$5,000 may trigger 14-day verification hold
Additional Stat Sniper reserves:
Do not exceed 30% of monthly transaction volume
Are released after 180 days if no issues arise
Earn no interest
May be adjusted based on ongoing Creator performance
Fraud Review Holds
New Creator Verification:
First 7-14 days: Extended review for identity verification
First payout >$1,000: May extend to 21 days for manual fraud review
Required by Stripe and regulatory compliance
Ongoing Fraud Monitoring:
Transactions may be held if:
Single transaction >$5,000 (3-7 day review)
Rapid subscription growth (>50 new subs in 24 hours)
Geographic fraud patterns detected
Subscriber fraud reports received
Chargeback spike occurs
You will be notified via email within 24 hours of any fraud hold.
Tax Responsibility
You are solely responsible for all taxes on Creator earnings.
Tax Form Issuance via Stripe:
Since Stat Sniper uses Stripe Connect for payment processing, Stripe (not Stat Sniper) is responsible for issuing tax forms and reporting to the IRS.
United States Creators:
Stripe will issue IRS Form 1099-K if you receive >$5,000 in gross payments in a calendar year (current threshold as of 2024; may be lowered to $600 in future years per IRS regulations)
Stripe collects your W-9 (Tax ID) during Stripe Connect onboarding
1099-K forms are issued by Stripe via your Stripe dashboard by January 31
Stripe reports your earnings to the IRS under their own Tax ID (EIN), not Stat Sniper's
Your Tax Obligations:
You must report all Creator income to the IRS regardless of whether you receive a 1099-K
Estimated quarterly tax payments may be required if you earn substantial income
Self-employment tax (15.3%) applies to Creator earnings
You are responsible for all federal, state, and local taxes
International Creators:
Stripe collects Form W-8BEN during onboarding to determine tax treaty benefits
Tax obligations vary by country (VAT, GST, income tax, etc.)
US tax withholding (30%) may apply unless you complete Form W-8BEN and claim treaty benefits
Stripe handles US tax withholding and reporting if applicable
You are responsible for tax compliance in your home country
Important Notes:
Stat Sniper does NOT collect tax information directly (Stripe does this during their onboarding)
Stat Sniper does NOT issue 1099 forms (Stripe issues them)
Stat Sniper does NOT report your earnings to the IRS (Stripe does this)
All tax documents are available through your Stripe Connected Account dashboard

5. CONTENT RULES & PROHIBITED CONDUCT
This section defines what Creators MAY and MAY NOT do on the Platform.
Violations may result in content removal, earnings forfeiture, and permanent account termination.
You MAY:
Post picks, predictions, betting models, and sports analysis
Share your personal performance history and track record
Sell subscription access to private content and premium picks
Use a personal brand, pseudonym, or professional identity
Charge different prices for different content tiers
Offer discounts, promotions, or limited-time offers
Discuss betting strategies, bankroll management concepts, and risk management
Reference specific sportsbooks where you place bets
Share screenshots of betting tickets as proof of actual wagers
You MAY NOT:
Illegal Gambling Claims & Misrepresentation:
Guarantee wins or outcomes — No "guaranteed winner," "lock of the century," "can't lose" claims
All Creators must display the following disclaimer on their profile:
"Past performance is not indicative of future results. Sports betting involves risk and you may lose money. Bet responsibly."
7. GAMBLING DISCLAIMERS & USER RISK
No Guarantees
Users may lose money following your content.
You agree that:
Betting inherently involves risk of financial loss
Past performance does not predict future outcomes
You are not providing financial advice or investment recommendations
You cannot control game outcomes or external factors
Variance and luck play significant roles in short-term results
You are solely responsible for statements made to users.
Required Responsible Gambling Notices
All Creators must include responsible gambling resources in their profile:
Suggested language:
"Bet responsibly. Gambling can be addictive."
"If you or someone you know has a gambling problem, call 1-800-GAMBLER."
"Never bet more than you can afford to lose."

Indemnification for User Losses
You agree to indemnify Stat Sniper against any claim arising from:
Users losing money based on your picks or analysis
Misrepresentation of win rates, ROI, or track record
Alleged "guaranteed" or "risk-free" picks causing financial harm
Claims of professional gambling advice without proper licensing
Subscriber allegations of fraud, misrepresentation, or negligence
This indemnification obligation survives termination of these Creator Terms.
8. INTELLECTUAL PROPERTY & CONTENT LICENSE
Creator Content Ownership
You retain ownership of your content, including:
Written analysis and commentary
Betting picks and predictions
Original models, systems, or strategies
Branding, logos, and personal identity
License to Stat Sniper
By posting content to the Platform, you grant Stat Sniper a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to:
Host your content on Platform infrastructure
Display your content to users (free and paid)
Distribute your content across Stat Sniper's platforms (web, mobile, API)
Promote your content in marketing materials, social media, and advertisements
Analyze your content for platform improvement and ranking algorithms
Clip or excerpt content for promotional purposes (with attribution)
Create derivative works for platform features (e.g., leaderboards, highlights)
This license:
Lasts as long as content remains on Platform
Survives termination of your Creator account (for content we choose to retain)
Does not prevent you from licensing content elsewhere
Allows us to sublicense to third-party partners for platform operations
Promotional Use
We may promote your content and profile to grow the network, including:
Featuring you in "Top Creators" lists
Sharing your picks in platform-wide highlights or recaps
Using your performance data in marketing materials
Showcasing your content to prospective users
Creating case studies or success stories featuring your Creator journey
You may opt out of promotional use by contacting support, but this may limit your visibility and subscriber growth.
User Redistribution Restrictions
Subscribers may not:
Screenshot and repost your paid content publicly
Share subscription access with non-paying users
Resell your picks or analysis to third parties
Use your content for commercial purposes without permission
However:
Enforcement is not guaranteed — we implement reasonable anti-piracy measures but cannot prevent all unauthorized sharing
Subscribers bear responsibility for violations under our Terms of Service
You may report unauthorized redistribution for investigation
Third-Party Content Usage
You must have rights to all content you post:
Use only content you created or have permission to use
Do not post copyrighted images, videos, or text without license
Properly attribute any quoted or referenced material
Comply with DMCA and other intellectual property laws
Violations may result in:
Immediate content removal
DMCA takedown notices
Copyright strikes against your account
Suspension or termination of Creator status
Legal liability for copyright infringement
9. SUBSCRIBER DISPUTES & REFUND POLICY
Refund Authority
Stat Sniper has sole discretion to issue refunds to subscribers, which may be deducted from your earnings.
Refund Eligibility
Full refunds issued for:
Platform technical errors: Creator content failed to deliver due to system outage; Payment charged but access not granted; App crash preventing content access during event
Fraudulent Creator activity: Creator impersonating another person; Fake performance records discovered; Misleading marketing or false advertising verified
Content not delivered: Subscription purchased but Creator posted no content for 30+ days; PPV pick purchased but never posted; Creator account deleted immediately after payment
Pro-rated refunds issued for:
Partial service delivery: Subscription cancelled mid-month (unused days refunded); Creator suspended during active subscription period; Content removed for policy violation during subscription
No refunds for:
Pick quality or performance: Losing bets or poor ROI; Disagreement with analysis or strategy; User dissatisfaction with content quality; User's own betting losses
Buyer's remorse: Changed mind after purchase; Found cheaper picks elsewhere; No longer interested in sports betting
External factors: Sportsbook voided the bet; Game cancelled or postponed; Injury news after pick posted
Refund Request Window
Monthly subscriptions: 3 days from charge date for technical issues only
PPV picks: 24 hours from purchase for non-delivery only
Technical errors: 7 days from incident
Fraud claims: 60 days from discovery
Requests outside these windows may be denied.
Chargeback Policy
Chargebacks are treated as refunds + dispute fee:
When a subscriber files a chargeback with their credit card company:
Stripe automatically deducts full transaction amount + $15 dispute fee from your Connected Account balance
You are notified via email with chargeback details and reason code
You may submit evidence to dispute chargeback (receipts, delivery proof, communications)
Stripe reviews and makes final determination (typically 60-90 days)
If you win, funds + dispute fee returned to your account
If you lose, deduction is permanent
Chargeback rate thresholds:
<1.0%: Acceptable (industry standard)
1.0-2.0%: Monitored (may trigger Stripe reserve)
2.0-3.0%: High risk (additional Stat Sniper reserve applied)
Australia: Interactive Gambling Act restricts certain online gambling promotion
FTC Disclosure Requirements
If you receive compensation beyond Stat Sniper platform fees (e.g., sportsbook affiliate deals, sponsored content), you must:
Clearly disclose material connections to sportsbooks or brands
Use hashtags like #ad, #sponsored, #affiliate when applicable
Follow FTC Endorsement Guidelines
Not make misleading claims about products or services
Failure to disclose may result in:
FTC enforcement action (not our responsibility, but you're liable)
Content removal from Stat Sniper
Suspension of Creator account
Required Platform Disclaimers
All Creators must display on their profile:
"This content is for entertainment and informational purposes only. Sports betting involves risk of financial loss. Past performance does not guarantee future results. Bet responsibly. 21+ only."
Additional disclaimers may be required based on your location or subscriber base.
Geo-Restriction Rights
Stat Sniper reserves the right to:
Block Creator monetization in specific jurisdictions where legal risk exists
Require additional disclosures based on Creator location or subscriber demographics
Suspend Creators violating local advertising laws
Remove content that violates jurisdiction-specific rules
Terminate accounts operating in prohibited regions
Examples of geo-restriction actions:
Blocking Utah/Hawaii residents from monetization
Requiring UK Creators to include Gambling Commission warnings
Disabling Creator accounts in jurisdictions where platform is not licensed
Reporting & Cooperation
You agree to:
Cooperate with regulatory investigations or audits
Provide documentation if requested by authorities
Notify us immediately if you receive legal inquiries about your Creator activity
Comply with subpoenas or legal process related to your content
We may disclose your information to regulators, law enforcement, or other authorities as required by law.
11. ACCOUNT TERMINATION & SUSPENSION
Our Right to Terminate
We may suspend or terminate your Creator account at any time, with or without cause, including but not limited to:
Stat Sniper uses Stripe Connect for all Creator payments and subscriber transactions. The Creator Program's operation depends entirely on Stripe's continued service.
You acknowledge and agree that:
Stat Sniper does not control Stripe's operations or policies
Stripe may suspend or terminate services at any time for any reason
Stripe's decisions are independent of Stat Sniper's control
Payment processing is a critical dependency that may fail
Service Interruption Events
If Stripe or any payment processor suspends, restricts, or terminates services to Stat Sniper:
Immediate Effects:
New Creator enrollments will be suspended indefinitely
Existing Creator payouts may be delayed or suspended indefinitely
Subscriber payments may be blocked or cancelled
Active subscriptions may be terminated without refund
All monetization features may become unavailable
Creator Impact:
Pending earnings may be held by Stripe pending their investigation
Scheduled payouts may be delayed by weeks or months
Access to your Stripe Connected Account may be restricted
Historical transaction data may become inaccessible
No Liability for Payment Processor Actions
Stat Sniper is NOT liable for any consequences of payment processor actions, including but not limited to:
Stripe account suspensions, restrictions, or terminations
Delayed or failed payouts to Creators
Lost revenue during service interruption
Subscriber refunds or chargebacks initiated by Stripe
Compliance holds or reserve requirements
Changes to Stripe's fee structure or policies
Migration delays to alternative payment processors
No Refunds or Compensation
In the event of payment processor service interruption:
Stat Sniper will NOT issue refunds to Creators for lost revenue
Stat Sniper will NOT compensate Creators for delayed payouts
Stat Sniper will NOT guarantee migration to alternative processors
Creators assume all financial risk from payment processor dependency
Transition Period
If Stat Sniper secures an alternative payment processor:
Migration may take 30-90 days or longer
Creator re-enrollment may be required
New terms and fee structures may apply
Historical data may not transfer
Some Creators may be ineligible for alternative processors
Stat Sniper makes no guarantees about service restoration timeline or alternative processor availability.
Creator Acknowledgment
By enrolling in the Creator Program, you expressly acknowledge:
You understand Stripe's critical role in the Creator Program
You accept the risk of Stripe service interruption
You will not hold Stat Sniper liable for payment processor failures
You have no contractual right to payment processing services
Stat Sniper may permanently discontinue Creator Program if no viable payment processor is available
11B. REGULATORY COMPLIANCE & SERVICE SUSPENSION
Regulatory Environment
Stat Sniper operates in a complex and evolving regulatory environment. Federal and state laws governing sports betting content, gambling advertising, and financial services may impact the Creator Program.
You acknowledge that:
Gambling regulations vary significantly by jurisdiction
Regulatory interpretations may change without notice
State gaming commissions may assert jurisdiction over Creator content
Payment processors are subject to regulatory oversight
Federal agencies (FTC, FINRA, SEC) may regulate certain activities
Regulatory Suspension Rights
If any governmental authority, regulatory agency, court, or payment processor determines that Stat Sniper's Creator Program violates applicable law, regulation, or industry policy, Stat Sniper may immediately and without prior notice:
Suspend or Terminate Services:
Disable Creator monetization in specific jurisdictions
Suspend all Creator accounts in affected states or countries
Terminate the entire Creator Program platform-wide
Block subscriber access to Creator content in restricted areas
Cease all payment processing activities
Geographic Restrictions:
Implement IP-based geo-blocking for specific states or countries
Require Creators to verify and disclose their location
Prohibit monetization by Creators in restricted jurisdictions
Terminate Creators found circumventing geographic restrictions
Content Restrictions:
Remove or restrict certain types of Creator content
Prohibit specific betting-related terminology or claims
Require additional disclaimers or disclosures
Implement content pre-approval processes
Examples of Regulatory Triggers
Regulatory suspension may be triggered by, but is not limited to:
State Gaming Commission Actions:
Cease-and-desist orders from Massachusetts Gaming Commission
Licensing requirements imposed by New Jersey Division of Gaming Enforcement
Advertising restriction violations in Ohio, Pennsylvania, or other states
Investigation or inquiry by any state gambling regulator
Federal Regulatory Actions:
FTC enforcement action for deceptive advertising practices

Stripe determines Creator content violates Acceptable Use Policy

Temporary restraining order pending litigation
Final judgment requiring service modification or cessation
No Compensation for Regulatory Suspension
In the event of regulatory-driven suspension or termination:
Creators will NOT receive:
Refunds for lost revenue opportunities
Compensation for business interruption
Damages for reputational harm
Reimbursement for time or resources invested
Stat Sniper will NOT be liable for:
Lost subscriber revenue during suspension
Inability to continue Creator business
Costs of migrating to alternative platforms
Legal fees or compliance costs
Emotional distress or other intangible harms
Pending earnings:
May be held indefinitely pending regulatory resolution
May be forfeited if regulatory authority requires
May be subject to additional withholding or reporting requirements
Compliance Cooperation Required
If Stat Sniper receives regulatory inquiry, investigation, or enforcement action:
You agree to:
Cooperate fully with any investigation or audit
Provide requested documentation within specified timeframes
Cease prohibited activities immediately upon notice
Comply with any corrective action requirements
Participate in legal proceedings if required
Failure to cooperate may result in:
Immediate account termination
Forfeiture of all pending earnings
Legal action to compel compliance
Sharing of your information with regulatory authorities
Indemnification for Regulatory Violations
You agree to indemnify Stat Sniper for regulatory issues arising from your Creator activity, including but not limited to:
Fines, penalties, or sanctions imposed on Stat Sniper due to your content
Legal fees defending against regulatory actions related to your conduct
Settlement costs or judgments arising from your violations
Compliance costs required to remediate your violations
This indemnification applies even if Stat Sniper approved or failed to remove your content.
Force Majeure
Regulatory actions, court orders, and government mandates constitute force majeure events beyond Stat Sniper's reasonable control.
Stat Sniper's obligations under these Creator Terms are suspended during force majeure events.
Survival
This Section 11B survives termination of these Creator Terms and continues to apply to regulatory actions arising from your past Creator activity.
12. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
No Liability for Betting Losses
Stat Sniper is NOT liable for:
User betting losses based on Creator picks or analysis
Financial harm to subscribers from following Creator content
Inaccurate predictions, analysis, or recommendations
Third-party sportsbook failures, voided bets, or payout issues
No Liability for Platform Issues
Stat Sniper is NOT liable for:
Platform downtime, technical errors, or data loss
Failed payouts due to Stripe or bank issues
Account suspensions or terminations
Content removal or moderation decisions
No Liability for Revenue Loss
Stat Sniper is NOT liable for:
Lost subscriber revenue due to account suspension
Missed earnings opportunities
Algorithm changes affecting visibility
Market changes or competitive pressure
No Liability for Reputational Harm
Stat Sniper is NOT liable for:
Damage to Creator reputation from negative reviews or subscriber complaints
Public association with betting or gambling content
Disclosure of performance data or statistics
No Liability for Third-Party Actions
Stat Sniper is NOT liable for:
Subscriber chargebacks or payment disputes
Unauthorized redistribution of your content
Harassment or abuse from users
Regulatory actions or legal proceedings
Damages Cap
Our total liability to you shall not exceed the amount we paid you in the previous 3 months.
This cap applies to all claims, whether in contract, tort, or any other legal theory.

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.
We disclaim all warranties, express or implied, including:
Merchantability
Fitness for a particular purpose
Non-infringement
Accuracy or reliability
Uninterrupted service
Assumption of Risk
By becoming a Creator, you acknowledge and assume the risk that:
Betting content may damage your reputation
Regulatory changes may restrict monetization
Platform policies may change
Subscriber dissatisfaction may harm your brand
Income is variable and not guaranteed
13. INDEMNIFICATION
Your Indemnification Obligations
You agree to defend, indemnify, and hold harmless Stat Sniper, its officers, directors, employees, agents, and affiliates from any claim, demand, lawsuit, or liability arising from:
Creator Content & Picks:
Your picks, predictions, analysis, or recommendations
Subscriber losses based on your content
Misrepresentation of win rates, ROI, or performance
Alleged "guaranteed" or "risk-free" picks
Misleading marketing or deceptive advertising
Legal & Regulatory Violations:
Violation of gambling advertising laws
FTC violations or deceptive trade practices
Copyright infringement or IP violations
Fraud, impersonation, or illegal activity
Operating in prohibited jurisdictions
Tax & Financial Obligations:
Failure to pay taxes on Creator earnings
IRS audits or disputes
International tax withholding issues
Subscriber Disputes:
Chargebacks or refund claims
Harassment or abuse allegations
Breach of subscriber agreements
Unauthorized redistribution of content
Third-Party Claims:
Sportsbook complaints or legal action
League or team cease-and-desist letters
Allegations of insider trading or match-fixing
Scope of Indemnification
This indemnification includes:
Legal fees and costs
Settlement amounts
Judgments and damages
Regulatory fines or penalties
This obligation survives termination of these Creator Terms.
Defense Cooperation
If we are sued or threatened with legal action due to your conduct:
You will cooperate fully with our defense
You will provide requested documentation or testimony
You may be required to participate in mediation or settlement discussions
You will reimburse our legal costs
14. INDEPENDENT CREATOR STATUS
Not an Employee
You are an independent content provider, NOT:
An employee of Stat Sniper
An agent or representative of Stat Sniper
A partner or joint venturer with Stat Sniper
A contractor with employer-employee relationship
No Employment Benefits
You are not entitled to:
Salary, wages, or guaranteed income
Health insurance or benefits
Workers' compensation
Unemployment insurance
Retirement or pension plans
Paid time off or sick leave
Tax Treatment
You are responsible for:
Self-employment taxes (15.3% in US)
Quarterly estimated tax payments
Business expense deductions
Maintaining records for tax purposes
Stat Sniper will NOT:
Withhold income taxes
Pay employer-side payroll taxes
Provide W-2 forms (you receive 1099-K if applicable)
No Authority to Bind Stat Sniper
You may NOT:
Enter contracts on behalf of Stat Sniper
Make commitments or representations for Stat Sniper
Use Stat Sniper's name or brand without permission
Claim to be an official Stat Sniper representative
Violations may result in immediate termination and legal action.
15. MODIFICATIONS TO CREATOR TERMS
Right to Modify
We may modify these Creator Terms at any time, with or without notice, for reasons including:
Changes in legal or regulatory requirements
Platform feature updates or policy changes
Risk management or fraud prevention needs
Business model adjustments
Notification of Changes
We will notify you of material changes via:
Email to your registered email address
In-app notification or Creator dashboard alert
Posting updated terms on Platform
Notice provided at least 7 days before effective date for material changes.
Acceptance of Changes
Continued use of monetization features after changes take effect constitutes acceptance.
If you do not agree to modified terms:
Disable monetization features immediately
Withdraw available funds
Close Creator account
Continued monetization after effective date = binding acceptance of new terms.
Non-Material Changes
Minor changes may be made without notice, including:
Typographical corrections
Clarifications of existing policies
Administrative updates
16. GOVERNING LAW & DISPUTE RESOLUTION
Governing Law
These Creator Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
You consent to exclusive jurisdiction in Delaware state and federal courts for any disputes not subject to arbitration.
Mandatory Arbitration
All disputes arising from these Creator Terms must be resolved through binding arbitration, not litigation.

Administered by JAMS (Judicial Arbitration and Mediation Services)
Governed by JAMS Streamlined Arbitration Rules
Conducted in English
Location: Delaware (or remote/virtual if agreed)
One arbitrator mutually selected or appointed by JAMS
Arbitration Costs
Filing fees and arbitration costs:
Creator pays JAMS filing fee (typically $250-$1,500 depending on claim amount)
Each party pays own attorney fees unless arbitrator awards fees to prevailing party
Stat Sniper pays arbitrator compensation (unless Creator is prevailing party)
Small Claims Court Exception
Claims under $10,000 may be brought in small claims court instead of arbitration, at either party's option.

Stat Sniper may seek injunctive relief in court (without arbitration) for:
